- you revoke your consent on which the processing was based and there is no other legal basis for the processing;
- you object to the processing and there are no legitimate overriding reasons for processing;
- the personal data have been processed unlawfully;
- deletion is necessary to comply with a legal obligation under European or national law to which the controller is subject;
- the personal data has been collected in relation to information society services offered, in accordance with art. 8 para. 1 of the DPA.
If your data has been made public by us and we, as the data controller, are obliged to delete them in accordance with art. 17 para. 1 DSGVO, we will take appropriate measures, including technical measures, to inform other data controllers who process the published personal data that you, as the data subject, have requested the deletion of all links to these your data or of copies or replications of your data. This applies only insofar as the processing is not necessary.
(5) Right to limitation of processing: You have the right to request limitation of processing if one of the following conditions is met:
- if you have disputed the accuracy of the personal data, the processing may be limited for the duration of the verification of the accuracy of the data;
- if the processing is unlawful and you as a data subject object to the deletion of the personal data and request instead the restriction of the use of the personal data;
- if we, as the data controller, no longer need the personal data for the purposes of the processing, but you, as the data subject, need them for the purpose of asserting, exercising or defending legal claims;
- if you as a data subject have lodged an objection to the processing and it is not yet clear whether the legitimate reasons given by the controller outweigh those given by you as a data subject.
(6) Right to data transferability: As a data subject, you have the right to receive your personal data in a structured, common and machine-readable format. You also have the right to have your data transferred to another controller without hindrance by us, provided that the processing is based on consent and by means of automated processing and as far as technically feasible. This right does not apply if the processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in us.
(7) Right of objection: As a data subject, you have the right to object at any time to the processing of your data for reasons relating to your particular situation. If you object to the processing, we will no longer process your data unless we can prove compelling reasons for processing worthy of protection that outweigh your interests, rights and freedoms, or if the continued processing serves the assertion, exercise or defense of legal claims. (8) Automatic decision making including profiling: As a data subject, you have the fundamental right not to be subject to a decision based solely on automated processing (including profiling) which produces legal effects vis-à-vis you or significantly affects you in a similar way. However, we would like to point out that as a responsible company we do not use any technical measures for automated decision-making (including profiling measures).
(9) Right to withdraw your consent to data processing: As a data subject, you have the right to withdraw your consent to data processing at any time. This does not affect data processing that has taken place up to the time of consent. The revocation will be effective for the future. With the receipt of the revocation of consent, your personal data will be deleted.
